President Obama Proposes Capping Student Loan Payments at 10% of Discretionary Income

President Obama proposes to cap student loan payments at 10% of discretionary income as part of a package of proposals outlined by the White House Task Force on Middle Class Families on January 25, 2010. Debt would also be forgiven after 20 years in repayment.
This proposal would enhance the income-based repayment plan which was enacted by Congress as part of the College Cost Reduction and Access Act of 2007 and which became effective on July 1, 2009. Income-based repayment bases monthly payments on federal student loans on the borrower’s discretionary income, not the amount they owe on their student loans. Income-based repayment currently caps student loan payments at 15% of discretionary income and forgives the remaining debt after 25 years in repayment. Discretionary income is defined as the amount by which adjusted gross income exceeds 150% of the poverty line.
The changes to help middle class families will be proposed as part of the President’s federal budget for the fiscal year starting October 1, 2010 (FY2011). It is possible that the changes to income-based repayment could be implemented sooner by adding them to the Student Aid and Fiscal Responsibility Act, which passed the House of Representatives in 2009 but is still pending in the Senate.
This proposal would yield meaningful repayment relief to hundreds of thousands of borrowers whose federal student loan debt exceeds their income. It would cut their monthly payments by an additional one third and forgive the remaining debt sooner. For example, a borrower with $40,000 in federal student loans and an adjusted gross income of $30,000 a year could see their monthly payments drop from $172 in the current income-based repayment plan to $115 a month. This compares with the monthly payment of $460 under standard ten-year repayment and $278 under extended 25-year repayment. The acceleration of the loan forgiveness will ensure that borrowers are not still paying back their own federal student loans when their children enroll in college.
Income-based repayment is available to borrowers in both the Direct Loan and federally-guaranteed student loan programs. It may be used with Stafford, Grad PLUS and consolidation loans, but not with private student loans, Parent PLUS loans or consolidation loans that repay Parent PLUS loans.
Unfortunately, under current law the loan forgiveness is treated as taxable income, except for borrowers who qualify for public service loan forgiveness. (Borrowers who repay their loans in the Direct Loan program and work full-time in public service jobs get forgiveness of the remaining loan balance after 10 years.)

Update: President Obama’s proposal was enacted as part of the Health Care and Education Reconciliation Act of 2010, but with a delayed effective date. The improved version of income-based repayment will be available for new borrowers of federal student loans starting July 1, 2014. Existing borrowers will not benefit, as the changes are not retroactive.

My fience and i are in the same situation. $70000 in debt and knowone will help us consolidate the loans. Sally may is by far the worst. They will not consolidate and want huge monthly payments. They are also saying that her wages will be garnished if we do not pay.

i have a student loan for $23,000.00 i attended a school in 2000.The school was close after a couple of months. I didn't finish now they end up garnish my checks. I was wondering if i can get some help.the loan is with SML.

I think this is a good idea after all reducing the debt burden for students takes some of the pressure off them and should improve their results whilst at the same time ensuring that when they do start to work they'll have more of their salary available for other uses. It could also help reduce young people relying on high interest loans from companies like AdvanceLoan.net who provide short term lending. Overall, a lower student payment cap makes sense.

This loan forgiveness is a good idea. It's true that it's going to come from tax money, but what else is that being spent on? Police who don't do their jobs sajoo , hospitals that overcharge out of greed, government officials who are not helping people? The only public service where I live (Western PA) that actually works for the people is the VOLUNTEER fire dept.s.

There is a reason why 2014 is the effective date for this 10% cap. They want more people to default so they get more money. The mortgage bubble burst, the next bubble to burst is the student loan bubble. They know that. They have a plan and steps have been made to quiet street riots by violating posse commitatus through the US Marshall service. The whole deal is Usury and Debt Slavery of the American populace prior to 2014. We get nothing but a reason to leave the United States. Imagine a mass exodus of educated Americans. e.g., Infrastructure crumbling because all the engineers moved to china... Think about it. Debt Slavery is a Crime according to U.N. Law.

There is not much you can do. Student Loans are a scam designed by the federal government to enslave it's people in exchange for money. They all get a kickback for accelerating your debt so it's not in their best interest to help you get out of debt. It's basically a bottomless pit. When Bush was in power, they took 24% of my discretionary income. Bush's policies fucked me over. Now that Obama is in power they only take 21%. If the Republican's become the majority in congress, they are going to ruin this country. Don't let that happen. It was under the Clinton Administration that the US had the surplus. Reagan, spent too much on military. Bush spent too much on military. See the pattern? Neo-conservative right-wing moral majority types are the fuckers that are fucking you and me over.

It seems like I'll never be able to repay this debt. When Times were good, I was able to pay $1000.00 a month. But now I make about $1500.00 a month. And the interest is $1500.00 a month. The loans when I took them totaled $36,000.00. I know I've already paid back the principal, but the interest is killing me. I do not think I'll ever be able to repay back this loan! It's now up to over $80,000.00. What can I do?

I wonder how this will apply for those under wage garnishment of student loans. From what I understand how this system works, the nation needs an educated work force. In turn student loans are guaranteed by the US Government. Once the victim is past the grace period to repay the loan he finds a job that will allow him to eat and the government allows the loan companies to garnish 21% of his wages indefinitely and the low paying job is enough to pay interest only as that is what is paid 1st before the principle is paid. This Effectively makes the defaulted loan borrower a 21% slave forever.

First of all thanks a lot for the informative and useful information. I am a student so this question is really important for me. For this reason I always follow all publications about the student loan reform. Before several months my parents have got some paycheck loans in order I could pay for my college. My family does not have much money so this loan program is really needful for me. I hope that our government will solve all problems with this program and all student will be satisfied with this loan program.
